Information Shared with Third Parties

 We may employ outside agents, meaning other companies or individuals to perform functions on our behalf, such as sending postal mail and e-mail, conducting promotional activities, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service. These M.Y.R.A. agents have access to personal information needed to perform their functions, but may not use it for other purposes. Other than our outside agents, we keep all of your personal information private and will not share it with any third party, unless you have authorized us to or we are legally required to do so. M.Y.R.A. may also release personal information when we believe, in good faith, that such release is reasonably necessary to enforce or apply the provisions of our Terms of Use or to protect the rights, property or safety of M.Y.R.A., our users, or others.

The data we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). It may also be processed by staff operating outside the EEA who work for us or our suppliers. By submitting your personal data to us, you agree to this transfer, storing or processing.

Where we share or transfer your personal data, we will do this in accordance with applicable data protection laws and we will take appropriate safeguards to ensure its integrity and protection.

Your Rights Regarding Your Personal Data

You have the right to request that we remove your personal information from our databases and the right to access, update and correct inaccuracies in your personal information in our custody or control, subject to certain exceptions prescribed by law. In addition to your rights under the applicable data protection legislation and where we are permitted or required by applicable law and regulation, we will provide you, upon request, with a copy of your personal data and we will correct any errors identified by you. We will refrain from sending you marketing material without your express consent and will also comply with your request to stop sending any such further communications. You have the right to restrict our processing of your personal data as well as the right to lodge a complaint with supervisory authorities. All such requests, or any questions regarding this policy or handling of your personal data, should be addressed to our Data Protection Officer at frontdesk@myraentertainment.com.  Note that this provision does not apply to information that we collect automatically from your device or browser, as described in the paragraph entitled “Cookies” above.

 

Your Rights Under Data Protection Law (If You Are Based in the EU)

You have a right to ask us to confirm whether we are processing information about you and to request access to this information (“right of access”). You also have the right to be informed of the safeguards we have in place relating to any transfers of your information to another country.

You may ask us, or we may ask you, to rectify information you or we think is inaccurate, and you may also ask us to remove information which is inaccurate or complete information which is incomplete (“right to rectification”). If you inform us that your personal data is inaccurate, we will inform relevant third parties with whom we have shared your data so they may update their own records.

You have a right to obtain your personal data from us and to reuse it for your own purposes, perhaps for another service, without hindering the usability of the data (“right of portability”). This right does not apply where processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in us.

You have a right to seek the erasure of your data (often referred to as the “right to be forgotten”). You may wish to exercise this right for any reason, for example where it is no longer necessary for us to continue holding or processing your personal data you may withdraw your consent. You should note that we are entitled to and reserve the right to retain your data for statistical purposes. This right is not absolute, as we may need to continue processing this information, for example, to comply with our legal obligations, or for reasons of public interest.

You have a right to ask us to restrict our processing of your information (“right to restriction”) if: (i) you contest its accuracy and we need to verify whether it is accurate; (ii) the processing is unlawful and you ask us to restrict use of it instead of erasing it; (iii) we no longer need the information for the purpose of processing, but you need it to establish or defend legal claims; (iv) you have objected to the processing of your information being necessary for the performance of a task carried out in the public interest, or for the purposes of our legitimate interests. The restriction would apply while we carry out a balancing act between your rights and our legitimate interests. If you exercise your right to restrict processing, we would still need to process your information for the purpose of exercising or defending legal claims, protecting the rights of another person or for public interest reasons.

How Do We Protect Children’s Privacy?

This Site is not intended for anyone under the age of 18, and especially not for children younger than 13. If you are under the age of 18, you may not use the Site except with the permission or involvement of your parent or guardian. If we learn that we have collected any personal information from a child under the age of 13 without verification of parental consent, we will delete that information from our database as quickly as possible.

If you are based in the European Union, the above provisions relating to children’s privacy generally apply to children under the age of 16, but this may vary across different member states.

 

Your Acceptance of these Terms

This Privacy Policy was updated in July 2024. We reserve the right to amend this Privacy Policy at any time, to take account of changes in the law and our processing practices. Any such changes will be posted on this page and will be effective upon posting.  If we make a significant or material change in the way we use your personal information, the change will be posted on this page thirty (30) days prior to taking effect and registered users will be notified via email. We may also post a notice on our Site. If you access or use the Site after the effective date of any changes to the Privacy Policy, you agree to be bound by the updated Privacy Policy.

 

Your California Privacy Rights

Use of Personal Information

We may use or disclose the personal information we collect for one or more of the following business purposes:

To create, maintain, customize, and secure your account with us;

When we disclose personal information for a business purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

Your Rights and Choices

The CCPA provides California residents with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights, below), we will disclose to you:
- The categories of personal information we collected about you;
- The categories of sources for the personal information we collected about you;
- Our business or commercial purpose for collecting or selling that personal information;
- The categories of third parties with whom we share that personal information;
- The specific pieces of personal information we collected about you (also called “Data  Portability Requests.”)

If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
- sales, identifying the personal information categories that each category of recipient purchased (if applicable); and
- disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights, below), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
Debug products to identify and repair errors that impair existing intended functionality;
Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.);
Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent;
Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
Comply with a legal obligation; and/or
Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by emailing us at frontdesk@myraentertainment.com.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative;
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

A verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Personal Information Sales Opt-Out and Opt-In Rights

M.Y.R.A. does not sell personal information.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny you goods or services;
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
- Provide you a different level or quality of goods or services;
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
